Functionality: Not Just for Plaintiffs Anymore?
Moscone Center West, Level 2, Room 2001
All academic panel. Nonfunctionality is traditionally thought of as a requirement for trademark protection. A common question is whether the plaintiff's mark is functional. However, several recent cases and an influential law review article have found functionality of the defendant's use to be a defense to a Lanham Act claim. In this panel, we explore those cases and the potential for a new use of the functionality doctrine.
