CM20 Combating Counterfeit Goods: From Detection to Take-Down

An array of practical anticounterfeiting strategies and tactics, tailored for targeted brands and goods, will be presented. Speakers will share tips on how brand owners facing actual or threatened counterfeit products should form an anticounterfeiting team of their senior legal, finance, corporate relations, marketing, sales and design managers in cooperation with customs and law enforcement officials. Resources need to be committed to training team members in identifying and managing counterfeit goods in anticipation of both civil and criminal remedies. Other issues that are part of a well-managed, long-term anti-counterfeiting program will be discussed including: continued attention to supply chain integrity, building an arsenal of IP weapons in carefully selected geographic locations, applying timely, professional investigative techniques, establishing and maintaining relationships with government officials, active membership trade organizations, and forming coalitions with other brand owners (even competitors) in sharing information and seizure actions.

In 2001, the Doha Development Round of the World Trade Organization (WTO) negotiations mandated that its membership negotiate a multilateral system for notifying and registering geographical indications (GIs) for wines and spirits. In the ten years since, WTO members have been unable to agree on what form this multilateral register should take and how it should work, and three divergent proposals have already been submitted. Key government officials from Australia, Hong Kong, the United States and the World Trade Organization will discuss and debate their positions.
Issues to be addressed include:
- Registration of GIs among participating and non-participating members.
- Form of protection: presumption vs. voluntary GI database.
- Treatment of GIs that are generic in some countries.
- Administrative and financial costs for individual countries.
- Opposition or registration proceedings and who can object.
- INTA’s GI Multilateral Register Proposal.
- Extending GI registration beyond wines and spirits.
Stay until the end of the session for a sampling of numerous fine wines from various Northern California appellations, which is meant to highlight the issue of GIs.
