We are very pleased to announce Professor Dr. Helmut Köhler as our lecturer, who will speak on the following topic: Direct versus vicarious liability/accessory to infringement in Trademark and Unfair Competition Law
The chambers of the German Federal Supreme Court have each developed their own different dogmatic approaches to the liability of a person who contributes to an IP infringement without being a direct perpetrator. Particularly, the decision, "Kinderhochstühle", delivered by the I. Senate, and the "MP3 Player Import" decision delivered by the Xa. Senate in a patent infringement case, have been the subject of controversial discussion and highlight the need for a more uniform and consistent approach to indirect infringement.
