In the current digital age, the Internet has fast become an important trading channel for counterfeiters in Malaysia. The internet provides an expansive platform for increasing the sales of counterfeits as seen from the increasing number of websites dealing with counterfeits. Hence, a discussion on the adequacy of the existing IP regime in the protection and enforcement of intellectual property rights  (including the passing of the Copyright (Amendment) Act 2010 in October 2011 and the Trade Descriptions Act 2011 which came into force on 1st November 2011) as well as the different measures and avenue available in enforcing the rights of IP owners  against online counterfeiters would be timely and important.

The session will cover the following areas:

  • Types of online counterfeiting activities.
  • Existing IP laws and regulations in place (including the Trade Descriptions Act 2011 and the Copyright (Amendment) Act 2010) which deal with online counterfeiting in Malaysia and whether such laws provide sufficient avenue to uphold the rights of Intellectual Property owners.
  • Available measures and proposals on how to protect and take action against online counterfeiters.
