We selected this topic, because the national offices in the EU carry out different examination practices concerning the establishment of the Criteria for the Fulfilment Community Trademark Use Requirements. In most EU countries, if a CTM is used in a single country only, then the use requirement of a CTM is fulfilled. To the contrary, according the legal practice and standpoint of the trademark offices in Hungary and Benelux, if a CTM is used in a single country, then the use requirement is not fulfilled.
In Hungary a final decision was issued by the Hungarian Intellectual Property Office in connection with the above. The adverse parties have not filed request for reconsideration action against the decision of the Hungarian Intellectual Property Office to the Metropolitan Court.
In Benelux the decision issued by the Benelux Trademark Office was appealed in the case ONEL vs. LENO; the Court of Justice of the EU decided on December 19, 2012, as far as we know.
Dr. Imre Gonda would give a presentation and analyse the Decision ONEL/OMEL case No. C-2149/1 issued by the Court of Justice of the EU on December 19, 2012.
