Counterfeiting remains a serious and growing issue in Canada. In 2013, the introduction of Bill C-56, the Combating Counterfeit Products Act, brought anticounterfeiting to the forefront of the Canadian trademark legal community and the Canadian public in general. While we await further developments with respect to the Bill C-8 (formerly Bill C-56), a primer in what Canadian trademark lawyers can do to assist manufacturers, consumers, and retailers combat counterfeit goods, and a discussion of how Bill C-8 will alter available approaches in Canada, is timely. A leading practiioner in the area will provide a brief overview of the current counterfeit landscape, a discussion of recent cases and available remedies (both civil and criminal), and will lead a discussion on anticounterfeiting approaches in Canada and the ramifications of Bill C-8 on such efforts.
