The dispute resolution challenges arising from the new gTLD process, which presented brand owners and businesses with several dilemmas is the subject of this roundtable. Should they consider applying for a term at the top level - be it their brand or area of activity - or wait until a later date? Should they be concerned at the infringement possibilities that this program may present and revise their online brand protection strategies accordingly? David Taylor, a partner at Hogan Lovells based in Paris, considers the complex application process, the costs and driving factors, the objections and dispute resolution process in place for non-applicants, the risk of potential cybersquatting at the second level and the defensive strategies and rights protection mechanisms available.
Whilst clients- and some lawyers- may wonder what the fuss is about, or be otherwise unaware of this, the change marks a significant development for us all globally. We are looking at an unprecedented expansion of the Internet's addressing system in the coming years. The rationale given is a perceived shortage of Internet addresses, or domain names, thus in around a year from now, we will start seeing new gTLDs from the 1930 applications such as .PARIS, .LONDON, .BERLIN, .MUSIC, .HOTEL, .GAY and .BLOG.
