The New Decree on Sanctions Against Administrative Violations in the Field of Industrial Property

Decree No 97/2010/ND-CP was issued on September 21, 2010 and took effect on November 9, 2010 establishing administrative sanctions for violations of industrial property rights as part of an overall regulatory scheme promulgated under the Law on Intellectual Property of 2005 (last amended in October 2009).

This Decree has clarified a number of provisions of the IP Law to facilitate actions through administrative procedure, which is still the most common route for IP rights enforcement in Viet Nam. However, issues have remained in the Decree and its guiding Circular that need to be clarified further to ensure effective administrative enforcement.

A new Decree has been drafted which is scheduled to be promulgated in 2013 in substitution of Decree No 97/2010/ND-CP. This session is to discuss the changes introduced in the new Decree (as compared to Decree No 97/2010/ND-CP) and how they will contribute to the improvement of the administrative enforcement of IP rights in Vietnam.
