Cah-Nah-Dah, Cis-Boom-Bah: “Star Athletica” and Intellectual Property Protection of Fashion Products in Canada
The article discusses the multiple types of intellectual property protection that may be available in Canada for clothing and other fashion products. In particular, the article addresses the important delineation between copyright and industrial design protection. To illustrate the difference, the article considers how the uniforms at issue in the Star Athletica, L.L.C. v. Varsity Brands, Inc. United States Supreme Court decision would be dealt with under Canadian law.
