CT01 – MAXXXIMUM EXPOSURE – Part II: Moonshine, Major League, and Preliminary Injunction Madness!
Intermediate Level
The second day of this session will start with a preliminary injunction argument by two attorneys. After the arguments, the judge will render a decision. In the discussion that follows, the panel, consisting of counsel for both parties and the judge, will address how they handled the case, what worked and what did not, key issues, and much more. Critique and questions from the audience will conclude the session.

Intersect with the Latest Diet Trends

Americans continue to search for the “ultimate” diet. Every few years, a new so-called health benefit or weight loss craze seems to arise. Are trademarks that incorporate terms such as “low fat” and “low carb” effective as trademarks, or are they really just marketing tools? What is the impact of Food and Drug Administration, U.S. Department of Agriculture, Federal Trade Commission and other regulatory regimes on the choice and clearance of such trademarks? And how to certification marks, endorsement marks or company seals of approval come into play in this ever-changing environment?
