Protection of Trademarks: Some Legal Aspects of Litigation and Regulation
The round table will focus on three aspects of the protection of trademarks.
1. Remedies for an infringement in trademarks disputes
This topic will introduce what remedies are available under national and international level for a trademark infringement. The discussion will then move to practical consideration what must be examined before requiring these remedies, what evidences should be collected and filed, how to prove and calculate the damages.
2. The Boundaries of the Legal Protection of Well-Known Trademarks: the Problems of Legal Regulation
The discussion will primarily focus on contradictions existing under EU, international and national legislation, correlation between well-known trademarks and trademarks having reputation. The relevant case-law will also be reviewed.
3. Trademarks v. domain name disputes
Despite the fact that the number of trademarks and the domain disputes is constantly increasing some countries have not established any specific regulation and procedures in this respect. The discussion will explore possibilities of protecting trademarks owners’ rights in courts and propose solutions of the issue.
