Protecting Fashion: A Comparative Analysis of Fashion Design Protection in the United States and the European Union
The intellectual property protections for fashion designs vary in the United States and the European Union. This article analyzes the legal mechanisms for fashion design protection in the United States, the European Union, and the E.U. Member States of France, Italy, and the United Kingdom (also considering the effect of Brexit). Moreover, it discusses the potential impact of Star Athletica, L.L.C. v. Varsity Brands, Inc., and considers whether the current U.S. social, economic, and political climate will allow for U.S. IP laws to adopt protections that are similar to the European Union in the foreseeable future.
