The Trademark Modernization Act (TMA), passed in 2020, created new ex-parte procedures to challenge potentially fraudulent registrations and refined existing procedures for challenging applications. The TMA also changes response times for office actions and resurrects the presumption of irreparable harm for preliminary injunctions. What do these changes mean for companies who don’t want their registrations to be at risk? What does it mean for companies looking to clear obstacles that are blocking new marks from being registered?
