The Prima-Facie Evidence of Trademark Usage in Swiss Trademark Prosecution and Litigation (French)

The Swiss Federal Institute for Intellectual Property applies rather strict standards when assessing the prima-facie evidence for right-preserving use that trademark owners must submit in opposition or non-use cancellation proceedings. Even compared to the practice of civil courts, where full evidence is required, the standards are high.

At this roundtable—to be held October 12, in Geneva, Switzerland, in French—we will review these standards on the basis of case law.
