On January 1, 2008, the European Union acceded to the Hague System of International Design, thereby allowing E.U. companies to obtain protection of a design with a single application, not only throughout the European Union with the Community Design, but also in the countries that are members of the Geneva Act. The International System of Design Protection is intended to simplify procedures, reduce the costs for international protection and make administration easier. This international panel will examine the effectiveness of the process inside and outside the European Union and compare the international and the direct route for both Hague Agreement and non-Hague Agreement countries.

CT50 — Law Firm Best Practices in Trademark Clearance, Prosecution and Portfolio Management

Sharing many years of experience with a wide variety of corporate and firm practices, the panelists will compare and contrast how law firms handle their practices and deliver content to the client, thus revealing the wide disparity in practices within and between firms. Discussion will include types and levels of searches; when and if full searches should be requested; how the search results are delivered, and how deeply one drills down in a search and whether there is a standard. Speakers will also discuss how and by whom within a firm applications are prepared and submitted; whether there is redundancy or make-work in some systems; what demands are placed on the client prior to filing; whether fraud warnings are routinely issued; and whether an attorney or paralegal signs e-filings on the client’s behalf, and if so for a search what kind of paperwork authorization is in place. Learn how much has to be done in order to constitute adequate due diligence.

It is often critical to determining whether registration can be achieved over a prior mark and whether unauthorized use is infringing and in setting the outer limits of enforceable coexistence arrangements. As markets evolve, similarity is affected. Think of Apple and Cisco over the iPhone® personal digital assistant, as well as Apple Records and Apple over downloadable music.
