“This research is important because the “likelihood of confusion” standard sits at the center of trademark practice, and AI has changed the environment in which brand identity is created, leveraged, searched, compared, used or misused, and enforced. Trademark attorneys well-versed in using AI technology can evaluate visual, phonetic, and conceptual similarity more efficiently, surface patterns that others might otherwise miss, and bring greater consistency to parts of the analysis that are often time-intensive. But while the same technology can help identify and reduce confusion, it can also be used for more nefarious purposes and cause confusion at unprecedented speed and scale. That is why the IP community needs a clear-eyed understanding of both the opportunities and limitations of this technology. AI can be a powerful decision-support tool, but trademark law ultimately protects consumer trust, and trust still requires human judgment, transparency, sound data, and accountable governance.”
