Geopolitics, Embargos and Sanctions: Managing a Trademark Portfolio in a Volatile Market
Geopolitics plays a significant role in shaping intellectual property (IP) policies worldwide. The interplay between national interests, economic power, and technological advancement often dictates how countries approach IP protection and enforcement. Geopolitics has become a key factor in how countries around the world define their national IP policies and their participation in international treaties related to IP.
This geopolitical influence has increasingly manifested in the use of sanctions as a tool in the intellectual property landscape. Sanctions have evolved from a means to enforce IP rights and exert pressure on other nations to conform to international IP standards (e.g., the U.S. “301 report, the EU “third country report”) to a component of broader economic responses to geopolitical events, as seen in the IP-related sanctions deployed against Russia following its invasion of Ukraine.
This session will provide practical insights for IP practitioners navigating the complex landscape of sanctions in their everyday practice. Attendees will gain valuable tools and knowledge to handle sanctions-related challenges in their IP practice and to provide informed advice to clients operating in this evolving geopolitical environment.

Let’s Get Real: Top Anticounterfeiting Tips
In the world of both traditional marketing/branding channels and innovative social media platforms, brands are often the target of shrewd counterfeiting.
Our panel discussion will focus on the measures TMAs and other legal professionals have created and implemented to address counterfeiting, including:
- Effective tools to track and/or manage counterfeiting incidents, including working with outside counsel and other service providers.
- Approaches taken by brand owners and their legal teams with investigators, customs, the legal and justice system, and related online mechanisms (UDRP; Amazon; take-down orders) and which are helpful, and effective from a time, and cost perspective?
- The success of counterfeiting countermeasures such as adopting brand authentication technology, utilizing global searches, letters to retailers and online marketplaces, public awareness campaigns from the company and/or brand ambassadors or influencers.
- The importance of these countermeasures to brand owners in protecting their IP rights (including licensing arrangements with third parties); protecting their brand image and reputation; ensuring dangerous products are removed from the marketplace; and protecting consumers). We will also review the costs associated with implementing these measures and the costs resulting from the loss of rights and/or profits.
Our session will include a fun, interactive quiz for participants to determine if they can tell the difference between genuine and counterfeit articles!

Influencer Co-branding: Pros and Cons from the Marketing and Legal Perspectives
Brands have been harnessing the power of influencers to reach new markets. However, relationships between brands and influencers are not always easy. The lack of previous experience and the speed of the market have introduced risks and harmed some brands. New public and private initiatives have arisen in several jurisdictions looking to mitigate these risks.
Some influencers have even become brands themselves, so new co-branding scenarios may arise. Are traditional co-branding arrangements suitable when one of the involved brands is an individual?
In the world of social media marketing, where the rule is “the more viral, the better,” association with a well-known social media creator can have a lot of value. The primary difference between influencer co-branding and influencer marketing is that the influencer has a significantly more advantageous position with co-branding. With influencer marketing, you are marketing through an influencer. With influencer co-branding, you are forming a genuine partnership with an influencer. Is Influencer co-branding a trend that allows businesses to further leverage the brand of an influencer they partner with?
