Our Position

Operating an interactive website that offers to sell merchandise to a U.S. state and actually shipping a counterfeit item to a recipient in that state should be sufficient to establish jurisdiction.

Outcome

In agreement with INTA’s position, the court reversed the district court’s holding that there was no personal jurisdiction.
