Last month, INTA hosted a training on intellectual property (IP) protection for customs officials in collaboration with Hangzhou Customs. The event brought together law enforcement officials from Hangzhou Customs, brand owners, and IP professionals. Focusing on customs practices in the seizure of counterfeit goods, the discussion also delved into a wide range of issues, including parallel imports, cross-border e-commerce, and how enforcement agencies can collaborate with brand owners and online platforms.

The training featured in-depth discussions surrounding the procedures for the seizure and investigation of infringing goods, time limits for case handling, and the mechanism for transferring infringement cases to public security for criminal prosecution. Notably, Hangzhou Customs emphasized that rights holders are strongly recommended to clearly articulate their infringement claims in writing, substantiated with evidence such as authorization documents and evidence of product traceability.

In terms of enforcement coordination, rights holders and their legal counsels are encouraged to raise their concerns with public security officials to continue monitoring the case transfer between law enforcement agencies.

This recent customs training in Hangzhou has further solidified the cooperative mechanism that exists between INTA and China’s key customs authorities, which is instrumental in promoting the sharing of intelligence and best practices, and promoting collaboration among enforcement agencies at national, regional, and global levels.
