Our Position

The Court should grant Ezaki Glico Co., Ltd.’s petition for a Writ of Certiorari as the Third Circuit erred in determining that the appropriate test for assessing a product feature’s functionality is simply a matter of determining whether the product feature for which trademark protection is sought, is “useful.”
