Our Position

Mexican trademark owners should have the right to seek cancellation of a registration on the ground of bad faith, a right currently enjoyed by foreign trademark owners.

Outcome

The court confirmed the decision of the Mexican Institute of Industrial Property and did not permit the Mexican trademark owner to seek cancellation of a trademark registration claimed to have been obtained in bad faith.
