Use of a registered trademark as a company or trade name can be an infringing use within the meaning of Article 5(1) of the European Trademark Directive.

Outcome

The Court stated use of a registered trademark as a company name may be infringing if it is used in connection with goods and services such that it amounts to unfair competition.
