Our Position

The court should grant certiorari in order to resolve a long-standing split among the courts of appeal on whether a trademark owner must prove willful infringement as a prerequisite to recovering the trademark infringer’s profits from the sale of goods bearing the infringing mark.


The petition for a writ of certiorari was denied.
