Join us as Etienne Sanz de Acedo, CEO of INTA, presents the State of the Association Address and as INTA President Ronald van Tuijl sums up his presidential year and presents the President’s Award, Volunteer Service Awards, and Pattishall Award. The President’s Award recognizes exceptional INTA participants who, over the course of a career in trademark law, have made an outstanding contribution to the law and to the advancement of the Association. The Volunteer Service Awards are given to individuals who have provided exemplary volunteer service to INTA during the past year in the advancement of trademark law, committee objectives, pro bono services, and the Association. The Pattishall Medal for Teaching Excellence was established by Pattishall, McAuliffe, Newbury, Hilliard & Geraldson LLP in honor of Beverly W. Pattishall. Given every four years, the award recognizes educators in the business and legal fields for outstanding instruction in the trademark and trade identity field.

Speakers will consider opportunities and challenges in protecting, policing, and enforcing trademarks in today’s fast-paced business and digital marketplace. From the critical need for a symbiotic relationship between legal and business to the strategies for frontline attack, panelists will engage the audience with practical discussions around:

Trademarks and the Craft Beer Industry: Can Craft Breweries Maintain Their Collaborative Nature as the Industry Grows and Trademark Disputes Become the Norm?
This session will take an in-depth look at the craft beer industry and how its growth has affected the way craft breweries clear new marks and resolve trademark disputes. The craft beer industry has exploded over the past decade, with three craft breweries opening every day in the United States; the number of craft breweries has almost doubled over the last two years. With this exponential growth, craft brewers are struggling to come up with new trademarks for their breweries and for their individual beers. Add to that the fact that many breweries have limited resources to devote to legal costs associated with proper clearance work, and the result is that trademark disputes in the craft beer industry are on the rise.
Historically, this small, tight-knit community of brewers has been a collaborative group that has tackled trademark infringement by talking brewer to brewer and resolving trademark disputes with a phone call. It now appears, however, that collaboration is limited to brewing, and when it comes to their IP, trademark cease and desist letters and litigation are becoming the norm. Adding to the mix is the entry of “big beer” into the craft beer market with strategic investments over the past two years, in hopes of capturing craft’s popularity and, more important, a piece of the revenue from retail sales of craft beer.
The craft beer industry presents an interesting study of how growth affects an industry from a trademark perspective and how growth has further affected that industry’s collaborative approach to solving trademark disputes. Can this industry right itself and get back to its collaborative roots when it comes to trademark disputes, or has that time come and gone?

Live Mock Negotiation: The Good, the Bad, and the Ugly–It Is All About Perspective
This session will offer a firsthand glance at a live mock negotiation involving international and domestic parties and in-house and outside counsel negotiating the following complex, but familiar, cross-border scenario. One of the parties is a legitimate trademark owner that established rights first in China. The counterpart is seeking to secure trademarks rights in China as well, so it will engage in a negotiation to try to have the trademarks coexist in said country and worldwide. The situation will get complicated when the party wishing to register in China learns that the company that has prior rights in China starts selling products bearing the trademark in China and shipping internationally to such countries as the United States and Canada, where it owns registrations for the same trademark, is the true creator, and has been selling for years.

This session will focus on enforcement issues and practical suggestions related to social media violations. The panel will present real life scenarios that have been encountered and will discuss, on an interactive basis, practical solutions that could be used and followed to address the issues raised.
