The Use of Artificial Intelligence (AI) in Trademark Proceedings

This report, prepared by the INTA Emerging Issues Committee, Artificial Intelligence and Trademarks Subcommittee, explores how artificial intelligence (AI) has been used in proceedings in the United Stated and in some other jurisdictions, including Europe, India, and Australia.

The report also addresses how AI may be used outside the discovery process to assist litigators and trademark practitioners in opposition and other contentious administrative proceedings.

Finally, the report identifies certain current practices in the pre-litigation phase regarding the automation of the assessment of the prospects of success of legal claims by legal services providers.
