Report on the Implementation of China’s Amended Trademark Law

To raise awareness of bad-faith trademark registration issue, during the 2020–2021 committee term, the China Trademark Office Practices Subcommittee of INTA’s Trademark Office Practices Committee conducted a survey to identify the impacts of the legislative amendments (which came into force in November 2019) to the Trademark Law of the People’s Republic of China (PRC Trademark Law).
Survey questions focused on the main areas of the amendments, covering trademark warehousing, squatting problems, disciplining of trademark agencies, and increased penalties for IP infringement. In this context, the Report outlines the recommended strategy for how international brand owners and professionals outside China may better navigate the ever-evolving landscape of the trademark legal regime in China.
