U.S. Dilution Case Law Database Relaunched

The U.S. Subcommittee of INTA’s Famous and Well-Known Marks Committee (FWKMC) is pleased to announce the relaunch of the U.S. Dilution Case Law Database.

Over the past five years, the FWKMC has reviewed federal, state, and U.S. Trademark Trial and Appeal Board case law to create a searchable database showing, on a case-by-case basis, what evidence has (or has not) been found sufficient to find that a mark is famous, or to win or defend against a motion to dismiss or a motion for summary judgment. The Database includes more than 200 decisions, primarily from 2013 to 2018.

Why is this important? The Database can help members find authority to support their position in either bringing or defending a dilution claim.

The U.S. Subcommittee will continually update the Database and make updates available to INTA members.

Although every effort has been made to verify the accuracy of this article, readers are urged to check independently on matters of specific concern or interest.
