SESSION 1—Digital Brand Protection in a Changing Global Regulatory Environment
The role of online marketplaces in our daily lives has grown exponentially and has become the norm across the world. In recent years, social media has been playing a greater role in how and where consumers shop. This panel will explore the unique challenges and opportunities faced in an online world, including:
- Recent and ongoing developments in the global regulatory landscape that have already impacted or are likely to impact efforts to enforce trademark rights and protect consumers online
- The 2018 implementation of the EU General Data Protection Regulation (GDPR), which created significant challenges for trademark owners seeking to address cybersquatting and online infringement, phishing, and other brand abuse in light of substantial changes to the “WHOIS” domain name registration data system
- Proposals to update the EU Network and Information Security Directive (NIS2) and other initiatives that have important implications for online brand protection
- The increase of shoppable content on social media and how to address fake content/fake sales and enforce your IP rights
As other jurisdictions beyond the EU increasingly look to update their own laws relating to data protection and ecommerce, how can the global Internet ecosystem keep pace with the changing framework while still ensuring that appropriate tools remain available for trademark owners and other third parties seeking to mitigate online counterfeits and other infringements? Counterfeit products are an ongoing threat to consumer health and safety, and to the global economy. This panel will focus on the current legislation and case law on the issue of stopping counterfeit goods in transit at the Customs level. The discussion will include a comparison of past and current regulations, and recent case law decisions at the Court of Justice of the European Union (CJEU). The panelists will share opportunities and challenges for both the public and private sectors and how finding a solution must include enhanced public and private sector collaboration.

SESSION 3—Thinking Beyond Trademarks: The Importance of Designs and Copyrights
