A recent report published by OECD, namely “Global Trade in Fakes—A Worrying Threat,” estimates that the volume of international trade in counterfeit and pirated products amounts to as much as US $464 billion in 2019, or 2.5 percent of world trade. Counterfeiters continue to exploit complex trading routes, and counterfeit products are shipped by various means of transport, from small parcels to big containers. It is also apparent that counterfeiters tend to use multiple assembly points to produce counterfeit goods, and these assembly points are usually dispersed across several countries. Furthermore, the COVID-19 pandemic has increased the trade of counterfeit products to the online space, while the macroeconomic and macro-political factors further complicate cross-border investigation and enforcement actions. Therefore, authorities, brand owners, and intermediaries across regions need to work hand in hand to tackle the counterfeiting issue from a global lens. In this session, hear from authorities, brand owners, and intermediaries to share their insights and best practices in fighting against the global trade of counterfeit products.

Product reviews have been around forever, but new players, technologies and online business models mean it’s anything but business as usual. More and more consumers seek out online reviews, ratings and comparisons before making a purchase, so the appeal for brands to incentivize reviews and direct marketing dollars towards affiliated ranking/review sites and influencers is obvious. Yet there are traps for the unwary, as regulators across the globe have made it a priority to address the problem of “fake” reviews and similar deceptive practices that ultimately harm consumers. This session will discuss how to effectively harness the power of legitimate online reviews and rankings while avoiding pitfalls that can cause major problems — including deceptive “pay-to-play” reviewers, insufficient disclosure of incentives or material connections, and improper filtering out of negative consumer reviews. This session will also discuss what steps a brand can take when a competitor is improperly leveraging comparative reviews or rankings

Imagine a world where IP is protected and managed in a completely different way, where creators can easily and securely monetize their work, and where ii contracts allow creators to automate licensing. They can set license terms and receive payment automatically when their IP is used, without the need for intermediaries. Furthermore, blockchain can be used to create decentralized IP systems in which assets are managed and licensed directly by the rights holders. Discussions over the use of trademarks in public discourse are nothing new. Yet, uncertainty continues to dominate, in practice, on how to assess when such uses are lawful or, instead, constitute trademark infringement or dilution. When, in January 2023, Shakira accused her ex-husband of trading “a Ferrari for a Twingo” and “a Rolex for a Casio” in her instantly famous revenge song, trademark attorneys across the globe wondered, “Is such use a parody, referential use, descriptive use, or trademark dilution?” While no lawsuit seems to have been filed in that case, several prominent cases in this area are pending or have been decided across many jurisdictions. This panel of distinguished academics will address these cases and recent developments on the topic in Asia, the United States, and Europe.

In a world that’s more connected than ever—with brands spanning the globe—counsel for brand owners are routinely expected to represent their clients in multiple jurisdictions with different laws, languages, and cultures. Although they can learn the law, brand counsel may nevertheless have difficulty understanding cultural norms when mediating international disputes. However, lack of understanding of cultural differences can create unspoken barriers to successful dispute resolution.
The session will include a live-role-playing mediation during which our panel will play out several scenes that would typically occur in mediation. These scenes will demonstrate some top tips on how to conduct a successful mediation by avoiding cultural faux pas. The role playing mediation will be set in Singapore, following the International Chamber of Commerce (ICC) rules, and will focus on Singapore’s singular cuisine.

Cost: In-person Breakfast and Luncheon Table Topics are $85.
Refunds: There are no refunds given for Table Topics. Substitutions are allowed with other registrants from your organization.
Substitutions: If you cannot attend the Table Topic you registered for, please contact us requesting a substitution. All substitutions must be made by April 28. Any substitutions after April 28 can be made onsite with INTA staff at the Table Topic room.
Limits: You can register for a maximum of four (4) Table Topics during the 2023 Annual Meeting Live+. Seats are limited, to allow other registrants to attend.
Purchasing Onsite: Table Topic seats will be sold onsite for sessions that are not sold out. Please proceed to the Table Topic room to learn what topics are available for purchase.
No Show or Late: If you do not attend or are late for your topic, you cannot swap or substitute for a topic at a different time. If other days and times are available, you will need to purchase that topic.
If you are late by 15 minutes or more, you may not be allowed to join out of respect to the group that has already started.
