Mission

Develops and advocates the Association’s policy related to design rights. The committee monitors design case law, legislation and practice in various jurisdictions, including on the international, regional and national levels; completes analyses and and proposes policy recommendations to the Board. Work includes report and submission writing, interaction with IP Offices, government officials and design organizations, and advocacy in conjunction with relevant INTA committees and staff. The committee’s role is also to raise awareness on design-related issues among INTA membership.

Highlights

The Hague Agreement Concerning the International Registration of Industrial Designs

Model Design Law Guidelines to enable us to advocate good design law policy around the globe.

Guidelines for Examination of Industrial Designs to serve as a baseline standard for the practice of Industrial Property (IP) Offices in the examination of design applications.

The Committee has been actively participating in the evaluation of the European Union designs system and advocating for a new legal framework to provide more harmonized, clear, efficient, and user-friendly procedures taking into account new technologies. Based on the Committee’s input, INTA has:

  • Submitted along with ECTA and MARQUES a Joint Paper on Legal Review of EU Designs System to the European Commission and the EUIPO in July 2018
  • Submitted a Contribution to the Consultation on Design Protection in the EU to the European Commission in April 2019
  • Promoted accession to the Hague Agreement Concerning the International Registration of Industrial Designs, based on the Board Resolution of November, 2016
